Art. 1 – Website property – acceptance of the conditions of use
The following terms and conditions of use apply to the websites sas.ambrosetti.eu and to all connected websites. The Website is property of The European House - Ambrosetti S.p.A.
The European House - Ambrosetti S.p.A. reserves the right, at its discretion, to change, modify, add, or remove portions of these terms at any time. Please check these terms periodically for changes. The continued use of this site following the posting of changes to these terms will mean the user accepts those changes.
Art. 2 – Content
All text, graphics, user interface, visual interface, photographs, trademarks, logos, sounds, music, video, artwork and computer code transmitted through, or used in connection with the Site, with the exception of User Content as defined below (collectively, the “Content”), including but not limited to the design, structure, selection, coordination, expression, look and feel and arrangement of such Content, contained on the Web site is owned, controlled or licensed by or to The European House - Ambrosetti S.p.A., and is protected by trade dress, copyright, patent and trademark laws.
The user may use information about services and content (e.g. meeting records, videos, documents etc)made ??available for download by The European House - Ambrosetti SpA, provided that (1) he/she does not remove any proprietary notice from copies of such documents, (2) the information is used solely for personal, non commercial purposes and the information is not copied or published on any networked computer or transmitted by any other media, (3)The information is not altered in any way. More information on the conditions of use of the content are displayed on the contents (disclaimer on videos, documents).
By accessing, using the Site and/or downloading any materials or content from the site the user does NOT become the owner of any intellectual property rights on the Service or the contents accessed through the Service.
The user may not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made internationally available through the Site. The European House - Ambrosetti S.p.A. reserves the right to bar any such activity.
The user may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site or to any server connected to the Site, or to any of the services offered on or through the Site, by hacking, password “mining” or any other illegitimate means.
The user may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site. The user may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information on third parties, including but not limited to personal identification or information.
The user agrees that he/she will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or The European House - Ambrosetti S.p.A.’s systems or networks, or any systems or networks connected to the Site or to The European House - Ambrosetti S.p.A.
The user agrees not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other person’s use of the Site.
The user may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to The European House - Ambrosetti S.p.A on or through the Site or any service offered on or through the Site. The user may not pretend that he/she is, or that he/she represents, someone else, or impersonate any other individual or entity.
Art. 4 - Accounts, Passwords and Security
Certain features or services offered on or through the Site may require to open an account. The user is entirely responsible for maintaining the confidentiality of the information he/she hold for his/her account, including the password, and for any and all activity that occurs under his/her account. The user agrees to notify The European House - Ambrosetti S.p.A. immediately of any unauthorized use of his/her account or password, or any other breach of security.
The user not use anyone else’s The European House - Ambrosetti S.p.A. ID, password or account at any time without the express permission and consent of the holder of that The European House - Ambrosetti S.p.A. ID, password or account.
Art. 5 – Privacy
Additionally, by using the Site, the user acknowledges and agrees that Internet transmissions are never completely private or secure. He/she understands that any message or information sent to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.
Art. 6 – Links to other sites and to the KU Site
This Site may contain links to other independent third-party Web sites (“Linked Sites”). These Linked Sites are provided solely as a convenience to our visitors. Such Linked Sites are not under The European House - Ambrosetti S.p.A.’s control, and The European House - Ambrosetti S.p.A.is not responsible for and does not endorse the content of such Linked Sites, including any information or materials contained on such Linked Sites. The user will need to make his/her own independent judgment regarding his/her interaction with these Linked Sites.
Art. 7 - Disclaimer
The European House – Ambrosetti S.p.A. does not promise that the Site or any content, service or feature of the Site will be error-free or uninterrupted, or that any defects will be corrected, or that the use of the Site provide specific results. The Site and its content are delivered on an “as-is” and “as-available” basis. All information provided on the Site is subject to change without notice. The European House – Ambrosetti S.p.A. disclaims all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose. The European House – Ambrosetti S.p.A. disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to the use of the Site and/ or any The European House – Ambrosetti S.p.A. services. The user assumes total responsibility for his/her use of the Site and any linked sites. The user sole remedy against The European House – Ambrosetti S.p.A. for dissatisfaction with the Site or any such content. This limitation is part of the bargain between the parties.
The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action.
The European House - Ambrosetti S.p.A. reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason; (2) to modify or change the Site, or any portion of the Site, and any applicable policies or terms; and (3) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.
Art. 8 – Limitations of liability
Except where prohibited by law, The European House - Ambrosetti S.p.A. and its suppliers and distributors are not responsible for any lost profit, revenues or data, financial losses and direct or indirect, incidental, special, consequential, exemplary or punitive damages.
To the extent permitted by law, the liability of The European House - Ambrosetti SpA and its suppliers and distributors with respect to any complaint made in accordance with these terms, including claims for any implied warranty, is limited to the amount paid to us by the user for the use of the Services (or, discretionally, to a new provision of the Services).
Art. 9 – Indemnity
The user agrees to indemnify and hold The European House - Ambrosetti S.p.A, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against The European House - Ambrosetti S.p.A by any third party due to or arising out of or in connection with your use of the Site.
Art. 10 - Business use of the Service
If the user is entering into these Terms on behalf of a company, organization or another legal entity (an “Entity”), he/she is agreeing to these Terms for that Entity and he/she is agreeing to indemnify and hold The European House - Ambrosetti S.p.A, its officers, directors, employees, agents and affiliates, harmless from any claim, suit or action arising from or related to the use of the Services or his/her violation of these Terms including any liabilities or expenses arising from any demands, loss, damages, legal actions, judgements, court and legal costs.
The European House - Ambrosetti S.p.A. may disclose any information about the user (including his/her identity) if it determines that such disclosure is necessary in connection with any investigation or complaint regarding the use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) The European House - Ambrosetti S.p.A.’s rights or property, or the rights or property of visitors to or users of the Site. The European House - Ambrosetti S.p.A. reserves the right at all times to disclose any information that The European House - Ambrosetti S.p.A. deems necessary to comply with any applicable law, regulation, legal process or governmental request. The European House - Ambrosetti S.p.A. also may disclose the user’s information when it determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.
The user agrees that The European House - Ambrosetti S.p.A. may, in its sole discretion and without prior notice, terminate his/her access to the Site, for cause, which includes (but is not limited to) (1) requests by law enforcement or other government agencies, (2) a request by the user (self-initiated account deletions), (3) discontinuance or material modification of the Site or any service offered on or through the Site, or (4) unexpected technical issues or problems.
Art. 12 - Governing Law - Dispute Resolution
The user agrees that all matters relating to his/her access to or use of the Site, including all disputes, will be governed by the Italian laws. The competent court is the court of Milan.
Art. 13 - Void Where Prohibited
The European House - Ambrosetti S.p.A. administers and operates the www.aggiornamentoconoscenza.eu Site from its location in Milan, Italy; other sites of The European House - Ambrosetti S.p.A. may be administered and operated from various locations outside Italy. Although the Site is accessible worldwide, not all features, products or services discussed, referenced, provided or offered through or on the Site are available to all persons or in all geographic locations, or appropriate or available for use outside Italy. The European House - Ambrosetti S.p.A. reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product or service to any person or geographic area. Any offer for any feature, product or service made on the Site is void where prohibited by law. If the user chooses to access the Site from outside Italy, the user does so on his/her own initiative and he/she is solely responsible for complying with applicable local laws.
